It already has been abused. Dick Chenney Iraq War. Bush administration. Over a million dead Iraqi civilians and 5,000 US Military service members sadly perished, while big oil run by Bush administrators profited big.

I'm not convinced there has been any practical change tbh. Everybody has always deferred official acts as legal (assassinating Bin Laden for example). All the court really clarified is that prosecutors have the onus to convince a court that any charges brought were not official acts. Which is really what they have to do now anyway. It's already a high bar. I don't think it's gotten any higher.
