Do you mean a video displaying or performing my work? Complicated. So, I guess 3. If splits are integrated and used, I could live with it. Or if it's a review. Or if I released it cc0. But earning from my (or any other artist's) work without any form of agreement, no. Great question. 1000 $degen

Yes - I was about to publish some videos on drakula from my recent trip to Art Basel and then I figure out it could be problematic without asking for permission

That's an interesting case. If you were there on a press pass, abided by the regulations set out by the organisation, there is, in my mind, no doubt you can do that. Not sure if you were accredited, but I believe you should. If you were there as a visitor, I think that a review or report style of video would be okay. A video of the work as is... that's where it becomes more debatable. There are many factors in play. You could always reserve a portion of your earning for just in case. With how most people outside our mad world view this, you probably get a cease-and-desist letter first. Videos of works by people within our Web3 world... these people seem easier to reach and ask for permission just in case.

Absolutely. But if you are official press, you are reporting. Press monetizes, too. I think that's okay. And if you have doubt on a certain video, reserve some of the earnings for if they come knocking. I think what you do is very justified. You report, you promote art through your channels. I'm not a copyright or IP lawyer, but I believe that is allowed in any case. Worst thing that can happen with this is that people claim earnings. But probably, in a very rare case, you get a cease and desist letter. Then you simply take down the video and be done. You can always offer a split then, too, in good faith, if you want to keep the relation nice. I wouldn't worry too much, but hopefully an IP/copyright lawyer can be more precise about this.
