Do you mean a video displaying or performing my work? Complicated. So, I guess 3. If splits are integrated and used, I could live with it. Or if it's a review. Or if I released it cc0. But earning from my (or any other artist's) work without any form of agreement, no. Great question. 1000 $degen

Yes - I was about to publish some videos on drakula from my recent trip to Art Basel and then I figure out it could be problematic without asking for permission

That's an interesting case. If you were there on a press pass, abided by the regulations set out by the organisation, there is, in my mind, no doubt you can do that. Not sure if you were accredited, but I believe you should. If you were there as a visitor, I think that a review or report style of video would be okay. A video of the work as is... that's where it becomes more debatable. There are many factors in play. You could always reserve a portion of your earning for just in case. With how most people outside our mad world view this, you probably get a cease-and-desist letter first. Videos of works by people within our Web3 world... these people seem easier to reach and ask for permission just in case.

The problem is the financial aspects of people minting the video - you are actually monetizing it
