Smith's office stated that the case will be dropped because according to the policy of the Department of Justice, the current president cannot be prosecuted. In Friday's filing, Smith stated that his office needs "time to assess this unprecedented situation and determine an appropriate course of action that aligns with the policies of the Department of Justice." A judge in New York has ruled that the criminal trial of TornadoCash co-founder RomanStorm will be postponed until April 2025 to resolve differences in expert witness disclosures. The original trial date was set for December of this year. Storm's legal team has applied for an injunction to the US Second Circuit Court of Appeals to overturn the order regarding the expert witness, and its hearing is scheduled for November 12th.
