If you're actually curious the answer is twofold: 1) The people being deported are saying they are not part of TdA and they have not been found guilty of a crime. Invoking this centuries old war time act is intended to deny them due process rights. 2) The wording of the Act implies it's use is meant for war time. We are not at war with either TdA or Venezuela. Imagine a Democrat invoking this to deport any non citizen political opponent. It's executive overreach.

wokies are super mudd Not all rights are absolute: While the Constitution applies to everyone, the extent of certain rights may be debated in the context of immigration status. For example, the right to enter and remain in the country is not a constitutional right.

It's about the legal concept used - if permitted, it establishes precedent. If the authorities can do it to these gang members, they can do it to anyone they disagree with. Are you cool with a future woke dictatorship deporting people they disagree with using a similar argument?
