So am I understanding correctly that this eth was already “moved” back to L1 and so was basically already in a kind of L2 purgatory and could only ever be burned and not recovered? (I tried to read the spec)

When you deposit ETH it’s minted.  Therefore when you withdraw ETH it should be burned. 

For whatever reason (probably to save gas) we decided not to burn it immediately when a withdrawal is initiated, but to keep it in this contract and make it so that it can be burned permissionlessly.
