It’s not quite the case that federal banking licenses or fed reserve oversight would be required, as state regulated issuers are permitted (at least to some market size). Also, reserve holdings are arguably more stringent than typical bank reserve requirements—closer to existing rules for issuers of payment instruments.

I suspect that with time, we’ll get further guidance as to the current SEC’s view on PoS staking. But also, a non-litigious SEC doesn’t mean anything is in the clear from state AGs or plaintiffs bar suits, unless there’s greater legislative clarity.
