I’ve seen lot of attention and indignation over the fact this was FinCEN’s position but the DOJ prosecuted anyway. But leaving aside my own pov and the timing of this particular communication, this seems like exactly the type of thing we can and should expect in a Loper Bright / post Chevron world.

I’ll be curious to see if we ever get to the bottoms of “what is really going on there anyway?” … much as I think we’re wasting time on stablecoin legislation, it’s not obvious to me why or where there’s such strong opposition/hesitation suddenly.

Hadn’t considered a full treasury default but agree completely that dramatic instability of any kind will have a meaningful impact on stables, likely to the detriment of the dollar dominance generally and US crypto market power
