How it used to be: SEC investigation begins. Sometimes enforcement decides not to proceed. Sometimes it does and there's a Wells notice to give the company a chance to respond. Sometimes the Wells process gets enforcement to change its mind. Sometimes it doesn't, and there's a settlement or lawsuit.

Apple: I just saw a *very serious* NASA scientist being interviewed on CNN. She inadvertently made some hand gesture, and a fireworks show appeared behind her. Kept her cool, as did the hosts, but do you really think these wacky effects should be on by default?

Those of us who worked in DHS's early days got to know Sen. Lieberman as chair of our Senate oversight committee. Laser focused on keeping the nation safe—and yet unfailingly civil, gracious and good humored, even when issues were contentious. I am mourning his loss. RIP.

US power to surveil certain txns comes from Smith v. Maryland and the 3d party doctrine—seems to me that what DAAMLA and other like bills are trying to apply 3d party doctrine to software-facilitated peer-to-peer txns, which may run into 4th Am problems. Agree or disagree?
