Crypto Lawyers, Can we launch a class action lawsuit against the SEC for costing Americans citizens millions of dollars in missed token airdrops? I'm sure we could get enough people. Tell me why this is a dumb idea.

The primary problem with a class action against the SEC is that federal agencies are entitled to sovereign immunity. Under sovereign immunity, government entities/officers generally cannot be sued for monetary damages, which means that we couldn't force the SEC to pay for our missed airdrops

However, the SEC can be sued to change its behavior to comply with federal law. See, for example, Coinbase's pending lawsuit, as well as this lawsuit filed this morning against the SEC: https://storage.courtlistener.com/recap/gov.uscourts.txnd.386710/gov.uscourts.txnd.386710.1.0.pdf

Without the ability to recover, it doesn't surprise me that no lawyers have been willing to take on the case. That being said, I'd be happy to join the effort if you or anyone else in your network is interested in putting together a legal team My DMs are open
