Bym has read a lot of articles today about how FTX will pay, as there is now a completely different plan than the one announced in May, which said that they would get back 118% of the lost funds in USD (paid in stablecoins/USD). Today's news says that FTX creditors can only get back 10% to 25% of their crypto. However, there is no more specific information and it is still unclear whether they plan to pay back in crypto or cash? And will it be calculated at the crypto price when filing for bankruptcy at the end of 2022 (BTC $16K, SOL $12) Unlike many rumors on X, the payment plan has not yet been approved and no payments will be distributed until the court approves it. A court date has been set for October 7. Additionally, FTX will transfer 18% of the forfeited funds from the US Department of Justice into a special fund called the “Preferred Shareholder Compensation Fund” (~$230 million) to compensate FTX’s preferred shareholders (investors who held shares in the company before FTX collapsed).

Ripple and SEC Update This morning, Eleanor Terrett (Fox Business News) reported that a former SEC attorney who recently left the agency said that the SEC will “likely” appeal the ruling that XRP sales on exchanges are not securities. The SEC has until October 7 to file an appeal. Note that we have not heard anything official, all of this is hearsay, and the SEC filing an appeal is risky because Judge Torres’s ruling is currently an isolated ruling, and the other judges are not required to agree or follow it. However, if they appeal and lose, the ruling will be binding on all judges in the lower court. Plus, Grayscale recently reopened the XRP Trust without waiting for the appeal date, so maybe they already know something.

Visa will launch a platform for banks to issue fiat-backed tokens on Ethereum, making it easy to tokenize real-world assets (RWAs) like commodities and bonds. Spanish bank BBVA will be among the first to test the platform, with a pilot program expected to take place in 2025.
