Is a private right of action against the federal government for a violation of section 5(a), 5(c) & 17A of the Securities Act barred by the doctrine of sovereign immunity? Frankly, this feels like a total mockery of the federal securities laws for the government to both engage in fraud and sell unregistered securities

Good question! I can’t imagine that sovereign immunity question has ever been litigated in a securities law violation before. It would be great if one of the public buyers brought a claim.
