We all saw this coming though, right? With the SEC stepped back, states and class action lawyers will fill those shoes until there is binding precedent (either statutory or court made) which makes it clear when a digital asset is sold in a securities transaction vs. not.

We’ve all been advising that this could happen, yes, and from a legal advice pov this makes it more relevant than ever. But from a a political science pov I don’t get it. The “anti crypto army” clearly isn’t one that wins elections or friends.

The Oregon lawsuit names 31 assets, so I think they are just banking on losing or being preempted but getting to say “I told you so” when inevitably one of those assets crash or the developers behind one of them does something dumb that makes headlines. Ignoring all the ones that are named that don’t have issues.
