lol open client is not open source, it's a closed centralized platform... im not mad about Durov, im mad about Pertsev, and with all respects, i feel conflating or equating the two does a disservice to oss devs everywhere

My statement was principled in the fact that code is speech, and that devs should not be jailed for open source code. That being said, I am also not a fan of Durov or Telegram! Its not e2e encrypted, and Kremlin affiliated. I like signal much more. I also support the Tornado Cash developers.

i agree 99% with everything you've said here, but i feel like saying Durov's been jailed for "open source code" is still a lil lacking. he's been jailed for failure to moderate his closed-source backend, not for the open source client! i'd be deeply disturbed by the latter, but the former feels not-unreasonable

We actually are not fully sure why he was arrested yet. And it's not against the law to have a private closed source backend. That's how a lot of companies maintain their moat.

of course it's not illegal to have a closed backend? but if fb/x/goog was hosting child abuse material, that would be illegal, even if they open sourced their mobile client app or whatever. they host and deliver the content from the backend, and therefore they are responsible for moderating it.

and we don't "know" why he was arrested, but early indications are certainly that it's moderation related - https://www.reuters.com/world/europe/telegram-messaging-app-ceo-pavel-durov-arrested-france-tf1-tv-says-2024-08-24/ "Durov, who has dual French and United Arab Emirates citizenship, was arrested as part of a preliminary police investigation into allegedly allowing a wide range of crimes due to a lack of moderators on Telegram and a lack of cooperation with police, a third French police source said."

That's a slippery slope argument. Governments like to use it to destroy consumer e2e encryption. And I don't buy it.
