I'm hunting the origin's of this ditty down, which appears to have emerged from debates around encryption in the mid-90's, with the "speech" aspect doing some heavy lifting as it ties it to the 🇺🇸 First Amendment rights around "free speech." One example, which I think might be the landmark precedent, being "Bernstein v. U.S. Department of State" (1996) where the judge ruled that computer source code is protected speech under the First Amendment. (PS: I'm not a lawyer or legal scholar, just deeply interested in this intersection of law, right and philosophy of computing).
