I suspect part of this was “the hard way” Pelosi was referring to. Also setting up the pardon on the last day of Biden’s term.

If they pardon him, you have my full admission that not only is Biden as corrupt and untrustworthy as Trump, but that my judgment of these people should be called into question. If the pardon never comes, I doubt the many who are quick to project and suspect a Biden pardon will ever bother a similar visit to the mirror. Skin in the game. I maintain that he will never pardon his son, no matter how badly he would like to. Because for all their flaws, temperance is still a quality of these types. I said the same after his AG’s special counsel revealed Biden’s incompetence during the classified info probe. Biden was furious. But he will never fire him. Because of restraint. Because of the virtue of temperance. Trump would fire instantly. Such a fundamental distinction between those vying for power, absent in the venerated horseshoe model. I unfortunately lack the 3d geometry to make this stickier.

Hmm. I think if it’s real jail time he will pardon. Genuine surprise if he doesn’t.
