The birthright thing is going to be really bad for Indian immigrants. I was in the H1B queue for 9 years, didn't get my application approved yet. Fortunately, ended up marrying a US citizen and became a resident. You now can lawfully work in this country for 10 years, and have your children not be legal residents.

At least, that's my current reading of how this is implemented. Hopefully they have some exception for non-resident visas.

“All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside.” Seems pretty unambiguous to me
