The birthright thing is going to be really bad for Indian immigrants. I was in the H1B queue for 9 years, didn't get my application approved yet. Fortunately, ended up marrying a US citizen and became a resident. You now can lawfully work in this country for 10 years, and have your children not be legal residents.

At least, that's my current reading of how this is implemented. Hopefully they have some exception for non-resident visas.

I believe it'll come down to a Supreme Court decision still, as birthright is enshrined in the 14th amendment. executive order was a move to end it, but I don't think it simply ends so easily the interpretation I've heard from people who know more than me is that based on the wording “born or naturalised in the United States and subject to the jurisdiction thereof” the "subject to the jurisdiction thereof" will likely end up playing a key part in how birthright citizenship works moving forward, given the context of why the order was signed someone who's undocumented and entered the country illegally isn't "subject to the jurisdiction" of the US in the way someone who went through a legal immigration process is we'll see how it plays out

The new system makes no sense and shows a lack of thinking through consequences both intended and unintended. What do you think happens longer term - birthright goes away and gets replaced by something more residency based? Or just no one gets to be American anymore 🥲

that article is REALLY bad. The person who was living here undocumented and was saying they could use their child for status is really wrong. This is the type of language that scares people into thinking anchor babies are a thing. Source: am/was undocumented for a long time. They should really correct it to, if you are undocumented and you have a kid, you have to wait until that kid is 21 and also has a job that pays them above the federal poverty line x2 as they are signing up to take care of you if you ever need to tap into resources. Being on H1B and getting married is definitely the move. Having a kid solidifies you can do processing in the country while you wait. In the end, having a USA parent who is a citizen will outweigh and beat all hurdles imo.
