cancel culture is reputation slashing gone wrong

This is what I imagine for the future of things like news organizations. They put up a bond in the form of tokenized social credits that what they're reporting is true. If it's determined not to be, their reputation gets slashed.

This is completely subjective. If I am a good validator 99% of the time but one time I unbundle dozens of transactions and steal mev. I should be penalized. 
I guess my question is how do you differentiate from malicious attacks and non malicious intent
