Gary Gensler, the outgoing chairman of the U.S. Securities and Exchange Commission (SEC), said that the agency has never classified the two main cryptocurrencies β bitcoin and ether β as securities. The SEC chairman clarified that neither he nor his predecessor Jay Clayton had said that these two cryptocurrencies were subject to securities laws. When asked why Gensler did not explain the status of ETH and BTC directly, the official stated that his job required him to be extremely careful in verbal expressions. Gensler, who was previously appointed to the post of SEC chairman by the Joe Biden administration, called bitcoin an extremely speculative asset. However, he acknowledged the growing popularity of the first cryptocurrency worldwide, so he does not rule out that BTC may become an analogue of gold in the future.
