In July, the SEC sent a Wells notice to Consensys for failing to register as a broker through the MetaMask Swaps service. Consensys then sued the SEC, claiming that its MetaMask Swaps and Staking services did not violate securities laws. Today, a judge in the Texas Court dismissed Consensys’ lawsuit on the grounds that the SEC has not formally sued Consensys, meaning the SEC has not said anything wrong, but Consensys has already fired back.
