If I just minted our brief as an NFT, it would definitely not be a security!  But there would have to be a lawsuit before anyone could submit an amicus brief (and if we were a party to the lawsuit, we wouldn’t be able to submit an amicus)!

We filed our amicus in Lejilex/CFAT’s case against the SEC. The lawsuit seeks a declaratory judgment that crypto secondary sales are not securities and Lejit.Exchange is not an exchange, broker, or clearing agency, and to enjoin SEC enforcement. More here:

Filed our amicus brief supporting the @blockchainassn and CFAT’s challenge to the SEC’s new dealer rule.  The rule meaningfully expands and muddies the definition of who is a securities “dealer” and may be used to sweep in broad swaths of DeFi.  More here:
