It's not super clear in your article what should have happened. Was this illegal?  Where should Way to Win have disclosed their activities?  I'm not clued in on election financing laws so it's hard to know what the specific wrong doing was.

I thought Instagram required an "Ad" tag when the influencer is paid but I have no doubt that's not strictly enforced. 

I can't imagine the FEC rules will be updated for social media under the current administration... if anything they'd be more likely to reduce the rules for TV and radio.

When a TV or radio ad appears, FEC rules require sponsorship disclosure at the end. No such rules for social media, so we have millions of dollars in secret money. Plus this was all routed through dark money 501cs that add an extra layer is secrecy.
