We’ve reached a decade since shifting to first to file — did we lose any benefits by abandoning first to invent? Certainly created a firestorm in the world of CRISPR.

The CRISPR thing is funny bc that was a massive legal battle over who invented first that got tons of publicity and that will probably never happen again. First to file is just really simple and easy.

A potential downside could be: inventor A invents X first, but can’t afford to file; inventor B independently invents X after A and files. A loses out. However, in reality I doubt this happens much, since A can file a pretty cheap provisional app and keep their rights pending until they can get financing.
