Judicial review is important, obviously, but he’s pointing at a real problem. In California, for example, a big part of the nimby problem is judicial activist expansion of laws like CEQA way outside their original intent.

I agree that this is not nothing, but he's creating a fake duality (the president gets his way every time OR it's not democracy) to serve his own interests. Democracy is a constant tension between the 3 powers, with sometimes abuses that need to be checked. But Elon is only interested in the domination of 1 power, not in balance.
