Skepticism of an Eth ETF is the only view that accounts for GG & Warren. GG repeatedly testified that BTC was a commodity. Even then, lawsuits had to force the issue. GG famously refused to say what Eth is. POS makes Eth different than BTC. Argument used against Solana in SEC v. Coinbase will easily stop an Eth ETF.

What do you make of the fact that the SEC already approved a futures ETF for Eth? It’s literally the same exact reasoning from the BTC case. You really think the SEC wants to pick another fight they are guaranteed to lose? I doubt it.

I think this is the real crux of it and it will come down to risk/reward for GG&co. Will be try to cap his downside risk if Biden loses? Or is he more concerned how Warren feels about him?

I would agree with you if the SEC’s Enforcement Division weren’t already stretched super thin. They have been filing tons of lawsuits and they only have so many lawyers. GG is going to keep fighting crypto but I think he knows better than to waste limited resources on an obvious loser. Time will tell
