A purported quote by Rauschenberg to collector Robert Scull at a 1973 Sotheby’s auction, after his “Thaw” (1958) artwork sold for $85,000, that Scull initially bought from Rauschenberg for $900. Rauschenberg went on to lobby and advocate to implement a royalties law in the US, an unsuccessful effort at the federal level, with some impact on a royalty law in California that is rarely used.

From the draft preamble: ‘The ACDA transforms your artwork into a defined, art-centered asset, wrapped and protected by a set of rules at the crucial point of first transfer, when it leaves your hands and enters the art market.’

Hans Haacke’s usage of the 1971 Siegelaub-Projanksy agreement for his Condensation Cube artwork in 1972. Each Transfer Agreement and Record is an analog equivalent of digital blockchain ledger entries for decentralized art. The beginning of provenance is shown in the first and second transfers, including names, price, and date. 1st Transfer : Thilo Liemersdorf. 2nd Transfer : Dr. Adolf Luther. The NOTICE associated with the artwork gives legal notice to all buyers of the artwork collectors that they are bound by the agreement, and can serve as a certificate of authenticity (COA) as well. The notice is an analog equivalent of contemporary NFTs, when used for these functions. Examples of the contract usage are sourced from Maria Eichhorn’s book, The Artist’s Contract.
