basically Smith had no choice given the OLC memo re prosecuting a sitting POTUS. He did leave the door open by filing “without prejudice.” It’s uncertain if tRump’s DOJ can file a similar motion but “with prejudice.” Smith made clear he felt charges were serious & legitimate.
